Al registrarse o utilizar FabriOS (en adelante "el Servicio"), producto desarrollado por FabriControl (en adelante "la Empresa"), usted acepta estos Términos y Condiciones. Si no está de acuerdo, no utilice el Servicio.
1. Aceptación de los Términos
Al crear una cuenta en FabriOS, usted declara que tiene al menos 18 años y que está autorizado a suscribir acuerdos en nombre de su empresa u organización. La Empresa puede modificar estos Términos con un aviso previo de 30 días publicado en la plataforma. El uso continuado del Servicio después de dicho plazo constituye aceptación de los nuevos términos.
2. Programa de Acceso Anticipado
FabriOS se encuentra actualmente en fase de Acceso Anticipado (beta). Durante este período:
- El uso del Servicio es gratuito por 6 meses desde la fecha de registro, sin necesidad de ingresar tarjeta de crédito.
- Al finalizar los 6 meses, el cliente podrá optar por un plan con "precio de fundador" en condiciones especiales. Para conocer las condiciones, contactar al equipo comercial por WhatsApp o email.
- Si el cliente decide no continuar, podrá exportar todos sus datos y dar de baja su cuenta sin penalidad alguna.
- Durante la beta, la Empresa podrá introducir cambios en funcionalidades, módulos y estructura del Servicio. Se notificará con al menos 7 días de anticipación cualquier cambio que afecte datos existentes.
3. Licencia de Uso
La Empresa otorga al cliente una licencia no exclusiva, intransferible y revocable para acceder y utilizar FabriOS mientras la cuenta esté activa. No está permitida la sublicencia, reventa ni distribución del acceso a terceros sin autorización escrita. La licencia incluye actualizaciones automáticas de la plataforma y acceso al soporte técnico.
4. Propiedad de los Datos
Todos los datos que el cliente ingrese en FabriOS (productos, órdenes de producción, inventario, clientes, cotizaciones y cualquier otro contenido) son propiedad exclusiva del cliente. La Empresa no vende, cede ni comparte datos del cliente con terceros, excepto cuando sea requerido por ley o para la operación del propio Servicio (por ejemplo, servicios de hosting). El cliente puede solicitar la exportación o eliminación definitiva de sus datos en cualquier momento.
5. Confidencialidad
La Empresa se compromete a tratar como confidencial toda la información operativa del cliente. El acceso a los datos está limitado exclusivamente al personal autorizado de FabriControl, con registro de auditoría de cada acceso. La Empresa no utilizará los datos operativos del cliente para fines distintos a la prestación del Servicio sin consentimiento explícito.
6. Limitación de Responsabilidad
FabriOS se proporciona "tal como está" y "según disponibilidad". La Empresa no garantiza que el Servicio sea ininterrumpido o libre de errores. En ningún caso la Empresa será responsable por pérdidas financieras, de producción, de datos o cualquier daño indirecto derivado del uso del Servicio. Durante el período de Acceso Anticipado (gratuito), la responsabilidad total de la Empresa se limita a los esfuerzos comercialmente razonables para restaurar el servicio.
7. Cancelación, Exportación y Jurisdicción
El cliente puede cancelar su cuenta en cualquier momento sin penalidad. Tras la cancelación, los datos del cliente se conservarán durante 90 días para permitir su exportación, luego serán eliminados definitivamente. Estos Términos se rigen por las leyes de la República Argentina. Cualquier controversia será sometida a los tribunales ordinarios de la Ciudad Autónoma de Buenos Aires, salvo acuerdo distinto entre las partes.

By registering for or using FabriOS (hereinafter "the Service"), a product developed by FabriControl (hereinafter "the Company"), you agree to these Terms and Conditions. If you disagree, do not use the Service.
1. Acceptance of Terms
By creating a FabriOS account, you declare that you are at least 18 years old and authorized to enter into agreements on behalf of your company or organization. The Company may modify these Terms with 30 days' prior notice published on the platform. Continued use of the Service after that period constitutes acceptance of the updated terms.
2. Early Access Program
FabriOS is currently in an Early Access (beta) phase. During this period:
- Use of the Service is free for 6 months from the registration date, with no credit card required.
- At the end of the 6 months, the customer may opt for a "founder price" plan with special conditions. To learn about conditions, contact the sales team via WhatsApp or email.
- If the customer decides not to continue, they may export all their data and close their account without any penalty.
- During the beta, the Company may introduce changes to features, modules, and Service structure. At least 7 days' notice will be given for any change affecting existing data.
3. License of Use
The Company grants the customer a non-exclusive, non-transferable, and revocable license to access and use FabriOS while the account is active. Sublicensing, resale, or distribution of access to third parties is not permitted without written authorization. The license includes automatic platform updates and access to technical support.
4. Data Ownership
All data entered into FabriOS by the customer (products, production orders, inventory, clients, quotations, and any other content) is the exclusive property of the customer. The Company does not sell, transfer, or share customer data with third parties, except when required by law or for the operation of the Service itself (e.g., hosting services). The customer may request the export or permanent deletion of their data at any time.
5. Confidentiality
The Company commits to treating all customer operational information as confidential. Data access is limited exclusively to authorized FabriControl personnel, with an audit log for every access. The Company will not use the customer's operational data for purposes other than providing the Service without explicit consent.
6. Limitation of Liability
FabriOS is provided "as is" and "as available." The Company does not guarantee that the Service will be uninterrupted or error-free. In no event shall the Company be liable for financial losses, production losses, data loss, or any indirect damages arising from the use of the Service. During the Early Access period (free of charge), the Company's total liability is limited to commercially reasonable efforts to restore the service.
7. Cancellation, Export, and Jurisdiction
The customer may cancel their account at any time without penalty. After cancellation, customer data will be retained for 90 days to allow export, then permanently deleted. To exercise any rights related to these Terms, contact info@fabricontrol.online.
These Terms are governed by the laws of the Argentine Republic. Any dispute shall be submitted to the ordinary courts of the City of Buenos Aires, unless otherwise agreed between the parties.

2. תוכנית גישה מוקדמת
FabriOS נמצא כעת בשלב גישה מוקדמת (בטא). במהלך תקופה זו:
- השימוש בשירות הוא חינם למשך 6 חודשים מתאריך ההרשמה, ללא צורך בכרטיס אשראי.
- בתום 6 החודשים, הלקוח יוכל לבחור בתוכנית "מחיר מייסד" בתנאים מיוחדים. לפרטים, ניתן לפנות לצוות המכירות בוואטסאפ או באימייל.
- אם הלקוח מחליט שלא להמשיך, הוא יוכל לייצא את כל הנתונים שלו ולסגור את חשבונו ללא קנס.
- במהלך הבטא, החברה עשויה להכניס שינויים בתכונות, מודולים ומבנה השירות. תינתן הודעה מוקדמת של לפחות 7 ימים על כל שינוי המשפיע על נתונים קיימים.
3. רישיון שימוש
החברה מעניקה ללקוח רישיון לא-בלעדי, שאינו ניתן להעברה וניתן לביטול, לגישה ושימוש ב-FabriOS כל עוד החשבון פעיל. אין לתת רישיון משנה, למכור מחדש או להפיץ גישה לצדדים שלישיים ללא אישור בכתב. הרישיון כולל עדכוני פלטפורמה אוטומטיים וגישה לתמיכה טכנית.
4. בעלות על נתונים
כל הנתונים שהלקוח מזין ב-FabriOS (מוצרים, הזמנות ייצור, מלאי, לקוחות, הצעות מחיר וכל תוכן אחר) הם בבעלותו הבלעדית של הלקוח. החברה אינה מוכרת, מעבירה או משתפת נתוני לקוחות עם צדדים שלישיים, אלא אם כן נדרש על פי חוק או לצורך הפעלת השירות עצמו. הלקוח רשאי לבקש ייצוא או מחיקה סופית של נתוניו בכל עת.
5. סודיות
החברה מתחייבת להתייחס לכל המידע התפעולי של הלקוח כסודי. הגישה לנתונים מוגבלת אך ורק לאנשי צוות מורשים של FabriControl, עם יומן ביקורת לכל גישה. החברה לא תשתמש בנתונים התפעוליים של הלקוח למטרות אחרות מלבד אספקת השירות ללא הסכמה מפורשת.
6. הגבלת אחריות
FabriOS מסופק "כפי שהוא" ו"לפי הזמינות". החברה אינה מבטיחה שהשירות יהיה רציף או נקי משגיאות. בשום מקרה לא תהיה החברה אחראית להפסדים כספיים, הפסדי ייצור, אובדן נתונים או כל נזק עקיף הנובע מהשימוש בשירות. במהלך תקופת הגישה המוקדמת (חינם), האחריות הכוללת של החברה מוגבלת למאמצים סבירים מסחרית לשחזור השירות.
7. ביטול, ייצוא וסמכות שיפוט
הלקוח רשאי לבטל את חשבונו בכל עת ללא קנס. לאחר הביטול, נתוני הלקוח יישמרו למשך 90 יום כדי לאפשר ייצוא, ולאחר מכן יימחקו לצמיתות. למימוש כל זכות הקשורה לתנאים אלה, ניתן לפנות ל-info@fabricontrol.online.
תנאים אלה כפופים לחוקי הרפובליקה הארגנטינאית. כל מחלוקת תוגש לבתי המשפט הרגילים של בואנוס איירס, אלא אם כן הוסכם אחרת בין הצדדים.
